About these terms
These Terms and Conditions govern your use of www.bottarga.com.au (the Website) and your dealings with Bottarga, including restaurant reservations, functions, gift cards and purchases made through the Website. The Website and Bottarga’s services are operated by The Trustee for Bottarga 2 Unit Trust, trading as Bottarga, ABN 44 876 416 588 (Bottarga, we, us or our), of 198 Bay Street, Brighton, Victoria 3186, Australia. By using the Website, making a reservation or placing an order, you agree to these terms and any additional terms shown to you at the time of booking or purchase. If you do not agree, please do not use the Website or complete the transaction. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.Website Information
We take reasonable care to keep information on the Website accurate and current. Menus, ingredients, availability, pricing, opening hours, events and other content may change from time to time. Images are illustrative and the appearance of dishes and products may vary. We may update, suspend or withdraw any part of the Website without notice. We do not guarantee that the Website, booking widget or third-party service will always be available or free from errors.Prices and Payment
Unless stated otherwise, all prices are in Australian dollars and include GST where applicable. Service fees or other charges will be displayed before you confirm a transaction. You must provide current, complete and accurate payment and contact information. Payments may be processed by third-party providers under their own terms and privacy policies. We do not ordinarily receive or store your complete card number. If a price or product description contains an obvious error, we may contact you to correct or cancel the affected transaction and provide a refund of any amount paid.
Restaurant Reservations
Reservations for 1–8 guests may be made online up to three months in advance. For larger parties, please email manager@bottarga.com.au. Groups of 8–12 guests may be accommodated in our private dining room, The Martin Room, subject to availability and separate function terms. Credit card details are required to secure all reservations. No charge is made at the time of a standard booking unless a deposit, prepaid menu or other charge is clearly disclosed. For last-minute bookings, limited online availability or booking-widget issues, please call (03) 9530 6515.
Walk-ins are welcome for drinks and dining at the bar. Dining-room seating for walk-ins is subject to availability. Menu selection and dietary requirements Because Bottarga is an intimate restaurant, you may be asked to confirm your menu selection when booking. The whole table must dine from the same set menu. The Tasting Experience and Chef’s Selection cannot be split across the same table.
Guests booking the à la carte menu may choose from dishes, snacks and seasonal specials available on the day. Menus, dishes and prices may change according to season and availability. Dietary requirements and allergies must be provided in the booking notes and raised again with our team on arrival. Some requests require advance arrangement and cannot be guaranteed.
AI Telephone Host Sadie
Bottarga uses an AI-powered telephone host named Sadie to answer incoming calls and assist ]=with restaurant reservations and general enquiries. Sadie does not make outgoing calls.
Calls handled by Sadie may be recorded and transcribed to process reservations, maintain accurate booking records, improve service quality and assist our team with customer enquiries. Callers will be informed at the beginning of the call that they are interacting with an AI host and that the call may be recorded and transcribed.
By continuing the call after receiving this notice, you acknowledge the use of Sadie and consent to the recording and transcription of the conversation. If you do not wish to be recorded, you may end the call and contact us by email at restaurant@bottarga.com.au or make a reservation through our website.
Sadie may collect information required to manage your reservation, including your name, telephone number, preferred reservation date and time, number of guests, dietary requirements, allergies, accessibility requirements and other booking notes.
Although we take reasonable steps to ensure Sadie provides accurate information, AI-generated responses may occasionally be incomplete or incorrect. A reservation is confirmed only when you receive confirmation from Bottarga or our authorised reservation platform. For urgent, complex or sensitive enquiries, please ask to speak with a member of our team or contact us by email.
Allergen, Storage and Product Disclaimer
We will consider seating preferences but cannot guarantee a particular table or area. Chef’s Selection The Chef’s Selection is currently priced at $99 per person, subject to change without notice. It is a shared menu of approximately 6–8 dishes selected by the kitchen and may change weekly. Most dietary requirements may be accommodated with sufficient advance notice. Dietary adjustments are possible only by prior arrangement.
Tasting Experience
The Tasting Experience is currently priced at $175 per person, subject to change without notice. A pescatarian version may be available on advance request. Due to the nature of the menu, dairy-free, gluten-free, vegetarian and vegan versions are not ordinarily available without prior arrangement. Last-minute requests cannot be guaranteed, and individual dishes generally cannot be modified or removed. Guests who do not eat seafood should book a standard reservation rather than the Tasting Experience.
Where a late dietary request requires additional ingredients or preparation, we may charge a reasonable surcharge if the amount is explained and agreed before service.
Dining Time and Minimum Spend
Dining-room reservations are allocated two hours unless otherwise stated. A minimum food spend of $65 per person applies to the dining room. Guests who do not wish to commit to the minimum spend may book the bar or front area. If the dining room has capacity on the day, we may offer dining-room seating, but may prioritise that space for guests who accepted the minimum spend
when booking.
Changes, Cancellations and No-shows
You may cancel or amend your reservation through our booking partner up to 48 hours before the reservation. Within 48 hours, please contact Bottarga directly. Where reasonably possible, we may offer to reschedule rather than charge a cancellation fee, but this is not guaranteed.
● A cancellation or reschedule made within 24 hours of a standard reservation may incur a fee of $65 per person.
● A no-show may incur a fee of $100 per person.
● For the Tasting Experience, Chef’s Selection or a group booking, cancellation or a reduction in guest numbers within 48 hours may incur a fee of $65 per affected guest.
● A booking of 9 or more guests may require a deposit and may be subject to separate private-dining or event terms.
You authorise us and our booking provider to charge the applicable disclosed fee to the card supplied to secure the reservation. Fees are intended as a reasonable contribution towards the loss associated with late cancellations, food ordered and prepared, staffing and the limited opportunity to rebook the table. We will consider exceptional circumstances fairly and in good faith.
If Bottarga must cancel a booking, we will notify you as soon as reasonably practicable and refund any prepaid amount for the cancelled booking. To the extent permitted by law, we are not responsible for unrelated or indirect expenses arising from a cancellation, except where the Australian Consumer Law requires otherwise.
Conduct and Service
Guests must behave respectfully towards staff, other guests and the premises. We may refuse entry, decline alcohol service, or require a person to leave where reasonably necessary for safety, responsible service of alcohol, unlawful conduct, harassment, threatening behaviour, serious disruption or breach of these terms. Alcohol will be supplied only in accordance with Victorian law and responsible-service requirements. Proof of age may be required.
Children and Accessibility
Families are welcome to book earlier sittings between 4:30 pm and 5:30 pm. A parent or guardian must supervise children at all times. We welcome guests who use wheelchairs. However, our restrooms are upstairs and may not be accessible to all guests. The premises are in a heritage building, which limits available modifications. Please tell us in the booking notes if you use a wheelchair or require assistance so we can prepare and explain the available access arrangements.
Functions and Private Dining
Functions, exclusive use and private-dining bookings may require a deposit, minimum spend, final guest numbers and menu confirmation by specified dates. Any event proposal, function agreement or written confirmation supplied by Bottarga forms part of the contract and prevails over these general terms if there is an inconsistency. Unless the function agreement states otherwise, deposits are applied to the final account. Cancellation charges must be reasonable and will reflect factors such as notice given, committed staffing, ordered stock, preparation, lost booking opportunities and costs that cannot reasonably be recovered.
The organiser is responsible for ensuring guests comply with venue rules and for paying the agreed account and any reasonable cost of repairing damage caused by the organiser or their guests, excluding fair wear and tear.
Gift Cards
Gift cards are issued by Bottarga and administered through Square. They may be used for eligible purchases at Bottarga, subject to any conditions displayed at purchase. Unless an exception under Australian law applies:
● gift cards are valid for at least three years from the date of issue;
●the expiry date will be clearly displayed;
● post-purchase administration fees will not be charged;
● gift cards are not redeemable for cash, except where required by law;
●lost or stolen gift cards may be replaced only if we can verify the purchase and unused balance; and
●if a bill exceeds the available balance, the difference must be paid using another accepted payment method.
Promotional vouchers provided free of charge, discounted offers and donations may have different validity periods and conditions, which will be disclosed when issued.
Online Gift Card Orders
An online order is an offer to purchase a Bottarga gift card. A binding sale is formed when we accept the order and send confirmation. We may reject or cancel an order where payment cannot be authorised, fraud is reasonably suspected, or a material pricing or description error has occurred. If payment has been taken for a cancelled order, we will refund it. Digital gift cards are normally issued instantly to the nominated email address through Square. Physical gift cards are available for collection from Bottarga from the next business day after ordering, during our advertised opening hours. We do not offer shipping or delivery.
Intellectual Property
The Website and its content—including text, menus, branding, photographs, graphics and layout—are owned by or licensed to Bottarga and are protected by intellectual-property laws. You may access and print content for personal, non-commercial use. You must not reproduce, adapt, publish, distribute or commercially exploit Website content without prior written permission, exceptas permitted by law.
Third-party Services and Links
The Website may link to or embed services operated by booking, payment, analytics, mapping or social-media providers. Those services are governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, but this does not limit any responsibility we have under applicable law.
Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. To the maximum extent permitted by law, we exclude implied terms that may lawfully be excluded. Where we are permitted to limit liability for a failure to comply with a consumer guarantee relating to services not ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again. Nothing in these terms limits liability for fraud, wilful misconduct, personal injury caused by negligence, or any liability that cannot lawfully be limited.
Changes to these terms
We may update these terms by publishing a revised version on the Website. The terms in effect when you book or purchase will apply to that transaction unless a change is required by law or agreed with you.

Bottarga respects your privacy. This policy explains how The Trustee for Bottarga 2 Unit Trust, trading as Bottarga, ABN 44 876 416 588, collects, holds, uses and discloses personal information. Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply to us, we will comply with them. We aim to handle personal information responsibly even where a particular legal obligation does not apply.
Personal information we collect
Depending on how you interact with us, we may collect:

●from booking, payment, gift card and marketing providers; and
●from publicly available sources where lawful and appropriate.
If you do not provide required information, we may be unable to process a booking or order, respond to an enquiry, accommodate a request, or provide a service safely. Where practical, you may deal with us anonymously or using a pseudonym. This may not be practical for bookings, payments, deliveries, complaint resolution or requests involving health and safety.
Sadie, our AI telephone host
When you call Bottarga, your call may be answered by Sadie, our AI-powered telephone host. Sadie identifies herself as an AI host and informs callers that the conversation may be recorded and transcribed. We use information collected through these calls to respond to enquiries, create and manage reservations, record dietary or accessibility requirements, provide customer assistance, maintain accurate business records and improve our telephone and reservation services. Call recordings, transcripts and associated reservation information may be processed by the technology providers that operate Sadie and our reservation systems on our behalf. We require service providers to handle this information only for authorised purposes and subject to appropriate privacy and security protections. Information about allergies, dietary requirements or accessibility needs may constitute sensitive or health information. By voluntarily providing this information after receiving the recording notice, you consent to its collection and use for managing your reservation and providing a safe dining experience.
If you do not wish to interact with an AI host or have your call recorded and transcribed, you may end the call and contact us at restaurant@bottarga.com.au or make a reservation through our website. You may also contact us to request access to or correction of your personal information, subject to applicable law.
Why we use personal information
We may use personal information to:
● process, manage and communicate about reservations, waitlists, functions, orders, payments, deliveries, gift cards, cancellations and refunds;
● provide restaurant services and respond to dietary, allergy, accessibility and seating requests;
● verify identity, age or payment where necessary;

● booking, waitlist and reservation-platform providers;
● payment processors, banks and fraud-prevention providers;
● gift card, website-hosting, email, customer-management, analytics and IT providers;

● government agencies, regulators, courts, law enforcement or emergency services where required or permitted by law;
● an actual or proposed purchaser, investor or adviser in connection with a business restructure or sale, subject to appropriate confidentiality protections; and

We do not sell personal information. Our principal technology providers include OpenTable for reservations, Stripe and Square for payments and gift cards, and Google and Meta for website analytics, advertising or related services.
Bottarga does not itself intentionally store customer information outside Australia. However, some technology providers may store, access or process information using overseas infrastructure. Their locations and practices may change and are governed by their respective privacy policies. Where the Privacy Act applies, we will take reasonable steps required by law in relation to any overseas disclosure.
Cookies and analytics
We use cookies and related technologies as described in our Cookie Policy. These may collect device and Website-usage information. You can adjust your browser or consent settings, but disabling some cookies may affect Website functionality.
Storage, security and retention
We may hold information electronically and in physical records. We take reasonable technical and organisational measures to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. No internet transmission or storage system is completely secure. Children’s Privacy

RETURNS AND REFUNDS POLICY
Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If a product or service has a major failure, you may be entitled to reject it and choose a refund or replacement, or cancel a service contract and receive a refund for the unused portion. You may also be entitled to compensation for reasonably foreseeable loss or damage. For a minor problem, we may choose to repair, replace, resupply or otherwise remedy it within a reasonable time. This policy does not limit those rights.
Change of Mind
Unless required by law or expressly stated at purchase, we do not offer returns or refunds because you changed your mind, ordered the wrong item, no longer want the item, found it cheaper elsewhere, or failed to follow storage or use instructions. For health and safety reasons, opened food, beverages and other perishable goods cannot be returned for change of mind.
Faulty, damaged, incorrect or unsafe goods
If a product is faulty, damaged, not as described, incorrectly supplied or unsafe:
1. stop using or consuming it;
2. keep the product and packaging where safe to do so;
3. take clear photographs; and4. contact restaurant@bottarga.com.au as soon as practicable with your order number and a description of the issue.
For perishable goods, prompt notice helps us investigate food quality and handling conditions. A
delay in contacting us does not remove rights that cannot lawfully be excluded.
We may request reasonable evidence and may inspect the product. Bottarga will pay reasonable
return costs where the product is confirmed to have a problem covered by the consumer
guarantees. Remedies will be provided in accordance with the Australian Consumer Law.
Restaurant services
If you are dissatisfied with a meal or service, please tell the manager promptly so we have a reasonable opportunity to understand and address the issue. Any remedy will depend on the circumstances and your rights under the Australian Consumer Law. A dish is not necessarily faulty merely because taste is subjective, provided it matches its description and is of acceptable quality. This does not affect rights relating to unsafe food, undisclosed allergens, misleading descriptions or other failures of a consumer guarantee.
Reservation cancellation fees
Refunds and fees for cancelled reservations are governed by the cancellation provisions in our Terms and Conditions and any specific terms disclosed when booking. If we cancel a reservation or cannot provide a prepaid menu or event, we will offer a suitable alternative, reschedule or refund as required by law.
Functions and deposits
Function deposits, prepayments and cancellation charges are governed by the applicable function agreement. Any retained amount will be consistent with that agreement and applicable law and will reflect reasonable loss rather than operate as a penalty.
Gift cards
Gift cards are not ordinarily redeemable for cash or refundable after purchase, except where required by law. If we make an error in issuing a gift card, or it is faulty or unusable, contact us for assistance.
Refund method and timing
Approved refunds will ordinarily be returned to the original payment method. Processing times depend on the bank or payment provider and are typically 5–10 business days after approval.

FOOD ALLERGEN, STORAGE AND PRODUCT DISCLAIMER
Allergies and dietary requirements
Food allergies can cause severe reactions, including anaphylaxis. If you or a guest has an allergy, intolerance, coeliac disease or another dietary requirement:
●tell us when making the reservation or order;
● provide clear details of the relevant allergen or requirement;
● speak directly with our team again before ordering and on arrival; and
● do not rely only on menu symbols, previous visits, online descriptions or another guest’s advice.
Menus and ingredients may change without notice due to seasonality, availability and supplier substitutions.
Shared kitchen and cross-contact
Our food is prepared in a working kitchen that handles common allergens, including wheat, gluten-containing cereals, fish, crustaceans, molluscs, egg, milk, lupin, peanuts, soy, sesame, tree nuts and sulphites. We take reasonable care and will explain what accommodations may be possible. However, shared preparation areas, equipment, fryers, storage and suppliers mean we cannot guarantee that any dish is completely free from an allergen or that cross-contact will not occur. Do not consume a product if the available information does not give you confidence that it is safe for your individual needs. Guests with severe or complex allergies should contact the restaurant before booking so we can discuss whether we can safely accommodate them. Nothing in this disclaimer excludes any duty of care or liability that cannot lawfully be excluded.
Menu descriptions and dietary labels
Terms such as “gluten-free”, “vegetarian”, “vegan”, “dairy-free” or “nut-free” describe intended ingredients or preparation but do not, by themselves, guarantee the absence of trace allergens or cross-contact in a shared kitchen.A pescatarian dish may include fish, crustaceans or molluscs. Vegetarian dishes may be prepared in an environment where meat and seafood are handled. Please ask our team if you need details.
Advance notice and menu limitations
Some menus cannot be modified without advance arrangement. The Tasting Experience is not ordinarily suitable for guests who do not eat seafood, and dairy-free, gluten-free, vegetarian or vegan versions may not be available. The Chef’s Selection is a shared menu and dietary adjustments must be arranged in advance. Late requests may be impossible to accommodate safely. Where extra ingredients or preparation are required, a reasonable surcharge may apply if disclosed and agreed before service.
Packaged and takeaway products
Check the product label, ingredient list, allergen declaration, use-by or best-before date, seal and storage instructions before consumption. Product photographs and online descriptions are illustrative; always rely on the label supplied with the product. If the label differs from the Website, or appears incomplete or damaged, do not consume the product and contact us.
Storage and handling
Follow all instructions supplied with the product. Unless the product states otherwise:
●refrigerate chilled food promptly at 5°C or below;
● keep frozen food frozen until required;
● keep hot food hot and consume promptly;
● do not consume food after its use-by date;
● do not consume food if packaging is damaged, the seal is broken unexpectedly, or the food has been left at an unsafe temperature; and
●reheat only as instructed and ensure food is heated thoroughly.
Once food has been collected, its safety may depend on prompt refrigeration, transport and handling. Bottarga is not responsible for deterioration caused by storage or handling contrary to supplied instructions, except to the extent caused or contributed to by Bottarga or where the law provides otherwise.
Raw or lightly cooked foods
Some dishes may contain raw or lightly cooked seafood, meat or eggs. These foods can carry an increased risk of foodborne illness. Pregnant people, young children, older people and people with weakened immune systems should seek appropriate health advice and tell our team before ordering.
Natural variation and bones or shells
Handmade and seasonal products may vary in size, colour, texture and appearance. Although reasonable care is taken, seafood and meat dishes may occasionally contain small bones, shell fragments or other naturally occurring material. Consume with appropriate care and tell us immediately if you identify an issue.
Alcohol
